If your value is more than .06,
you could be considered Impaired (DWI) in the State
of Michigan - at .10 or more, you could be considered
Drunk (OUIL)*.
*A person under 21 with .02 or greater violates Michigan
law. |
Drunk driving is serious offense, and it has become more
serious with the recent changes in Michigan law.
A first-time offender convicted of drunk driving could
receive:
- up to 93 days in jail,
- up to two years probation,
- $100 - $500 fine plus court costs and reimbursement
to the police for the cost of the arrest,
- 6-month driving-license suspension (eligible for restricted
license after 30 days), and
- loss of the use of your car for up to 6 months.
A second offender (within 7 years) could receive:
- up to 1 year in jail,
- up to two years probation,
- $200 - $1,000 fine plus court costs and reimbursement
to the police for the cost of the arrest,
- license revocation for one year, and
- forfeiture or loss of the use of your car for up to
six months.
A third offender (within 10 years) could receive:
- up to 5 years in prison,
- up to 5 years probation,
$500 - $5,000 fine plus court costs and reimbursement
to the police for the cost of the arrest,
- license revocation for 5 years, and
- forfeiture or the loss of your car for up to 3 years.
In addition to these penalties, all convicted offenders
face mandatory alcohol screening and possible community
service.
If you are involved in an accident, the penalties
are even more severe.
The police, prosecutor, and court treat drunk drivers very
seriously, but you may have a defense that could result
in a dismissal or a plea bargain to a less serious offense.
We should also discuss actions that you can take that could
result in a more lenient sentence.
